ARBITRATION PROVISIONS

Some agreements call for the use of an arbitrator, or private professional decision maker, to resolve disputes.  Many large organizations include arbitration provisions in their agreements.  An arbitration agreement may prevent a party to an agreement from being able to bring claims through the courts and can limit the types of damages available.  The arbitrator used for a dispute is generally selected from a list.  Because larger organizations tend to arbitrate more often, those arbitrators who are perceived to be more likely to favor the larger organizations tend to be selected more often by those organizations.  As a result, some have questioned the objectivity of arbitrators.
